These SMS Terms and Conditions (“Terms”) govern your participation in the Picture Build text messaging program (“Program”). By receiving SMS messages from Picture Build, you agree to these Terms.

1. Program Description

Picture Build operates an internal SMS notification program through the Picture Build System — a proprietary business management platform used by Picture Build employees and authorized contractors. The Program delivers:

• Account credential notifications (e.g., initial passwords and password resets).

• Operational notifications such as job status updates, scheduling alerts, and system announcements.

• Administrative messages from the Picture Build System platform.

Messages are sent on behalf of Picture Build by “Sam,” an AI assistant integrated into the Picture Build System.

2. Sender Identification

All SMS messages are sent from a phone number registered to Picture Build. The messages will identify themselves as originating from Picture Build or the Picture Build System. Our SMS sender is registered under the legal business entity Picture Build.

3. Eligibility and Consent

Participation in the Program is limited to Picture Build employees and authorized users who have been issued an account in the Picture Build System. By providing a mobile phone number and accepting an account, you consent to receive SMS messages as described in these Terms.

Consent to receive SMS messages is not a condition of employment or of any purchase of goods or services.

4. Message Frequency

Message frequency varies. You may receive messages when:

• An administrator creates or updates your account.

• A password reset or credential update is performed on your account.

• A system event relevant to your role occurs within the Picture Build System.

We do not send marketing, promotional, or third-party advertising messages via SMS.

5. Costs and Carrier Fees

Message and data rates may apply. Picture Build does not charge a fee to receive SMS messages, but your wireless carrier may charge you for sending and receiving text messages based on your plan. Contact your wireless carrier for information about your messaging plan.

6. Opt-Out Instructions

You may opt out of the Program at any time by replying STOP to any SMS message you receive from us. After sending STOP, you will receive one final confirmation message and no further messages will be sent to your number unless you re-enroll.

To re-enroll after opting out, reply START to the confirmation message or contact your account administrator.

8. Supported Carriers

The Program is available on all major US wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, MetroPCS, and U.S. Cellular. Carrier support may vary. Picture Build is not responsible for delayed or undelivered messages due to carrier issues.

9. Privacy

Your mobile phone number and any information you provide are governed by our Privacy Policy, available at picturebuild.com. We do not share your mobile phone number with third parties for marketing purposes.

10. Changes to These Terms

Picture Build reserves the right to modify these Terms at any time. Material changes will be communicated to users via the Picture Build System platform or email. Continued receipt of SMS messages after notice of changes constitutes acceptance of the updated Terms.

11. Limitation of Liability

Picture Build is not liable for any delays or failures in the delivery of SMS messages caused by your wireless carrier, network outages, or circumstances beyond our reasonable control.

12. Governing Law

These Terms are governed by the laws of the state in which Picture Build is incorporated, without regard to conflict-of-law principles.
